Dark posting

Dark posting influencer content: what it means, what it allows and why the disclosure still applies

Dark posting means running an ad whose post never appears on any feed. It changes who sees the creative, not whether the ad must be labelled, so the disclosure duties are the same as for a published post.

In short

  • A dark post is an ad that is never published on a feed. On Meta it is new media uploaded in Ads Manager; on YouTube, an unlisted video.
  • Dark does not mean hidden. Meta's Ad Library lets anyone search ads currently running across its products, and ASCI judges the ad, not the feed.
  • Meta says branded content posted as an ad or unpublished post must meet its Advertising Standards, and creators should use the branded content tool to tag the partner.
  • Keep the creator's label inside the creative, approve each version and log every variant. ASCI says an ad in the format of organic content must say it is an ad.

Dark posting means running an ad whose creative is not published on any profile's feed. The ad is built and delivered as an ad only, so it reaches the audience you target and nobody else. "Dark" describes the feed, not secrecy: the platform reviews the ad, labels it as an ad, lists it in Meta's Ad Library while it runs, and judges it by the same rules as any other ad. With influencer content, the extra question is whose name is on the ad and whether that person knew.

Our creator ads and whitelisting service covers the paid use of creator posts, Instagram partnership ads setup covers permissions, and usage rights for influencer content covers the rights. This post answers a narrower question that comes up in every serious creator-ads programme: what a dark post is, when it suits creator content, and why labelling and approval do not get lighter. For the wider picture, see our guide to influencer marketing in India. Meta's own pages say unpublished posts or ads, and dark post is trade slang. Menu names change, so confirm each label on screen.

What counts as a dark post

The routes below are the ones in our post on influencer content in Meta ads, plus the YouTube equivalent.

Set-upWhat existsWhere it appearsWhat the platform says
Brand-handle ad with new mediaA creative uploaded in Ads ManagerOnly as an ad, under your handleBranded content posted as an ad or unpublished post must comply with Meta's Advertising Standards
Partnership ad with new mediaMedia uploaded in Ads Manager with the creator's handle as an identity, under account-level permissionOnly as an ad, with the creator's name in the headerWith account-level permission, advertisers can create a partnership ad by uploading new content in Ads Manager
Unlisted YouTube video run as an adA video that is not public but plays from a linkOnly as an adAn unlisted video used as an ad will not show the channel logo, name or information
For contrast: a boosted postA published postOn the feed and as an adNot dark

The first row comes from Meta's page on branded content in published posts, the second from its partnership ad instructions, and the third from Google's page on skippable in-stream ads.

Why brands use it with creator content

  • Many cuts, no clutter. A creator's grid and your own stay clean while you test six openings, as partnership ads creative testing describes.
  • A shape made for ads. A 20-second re-cut with a new hook does not need to be posted at all.
  • Audience-specific versions. The same creator in Tamil for Chennai and in Hindi for Lucknow, each shown only to its market.
  • Time-limited offers. A price that ends on Sunday should not sit on a feed for a year.
  • Separate comment threads. Questions on the ad stay on the ad.

The honest risk sits on the same list. A dark creator ad can put a creator's name on a message they never saw. That is the point at which a contract matters more than a platform setting.

What dark does not change

  1. The platform still reviews it. Meta says a partnership ad is reviewed and you are notified when it is approved.
  2. It can still be seen. Meta's Ad Library lets anyone search ads currently active across its products, and an ad that breaks Meta's policies can appear there with a warning. We could not confirm from Meta's page how listings work for India, so search your own advertiser name there and see what a regulator or a rival would see.
  3. The label duty is the same. The rules below apply to the ad, not to the feed it did or did not sit on.
  4. The creator's name is still borrowed. A partnership ad shows the creator in the header under permission that they can revoke at any time.
  5. Responsibility is shared. ASCI puts the duty to make the disclosure on the influencer and the duty to make sure the ad follows its code on the advertiser, who may call on the influencer to edit or delete.

The rules that still apply

SourceWhat it saysWhat it means for a dark creator ad
Meta Branded Content PoliciesBranded content is a creator's content featuring or influenced by a business partner for an exchange of value, posted with the branded content tool, and you must give the disclosures the law needsTag the partner; the ad slot is not an exemption
Meta, branded content as an ad or unpublished postIt must comply with the Advertising Standards, and creators posting branded content as an ad should use the branded content tool to tag the partnerPartnership ads do this by design
ASCI influencer guidelinesA disclosure label is needed when there is a material connection; upfront and prominent; at least three seconds in a video of 15 seconds or less and one third of the length under two minutes; permitted words include Ad, Sponsored, Collaboration and PartnershipThe label travels with the creative, so we keep it inside the video
ASCI deceptive design patterns (from 1 September 2023)An ad in a format similar to editorial or organic content must clearly disclose that it is an ad; influencer posts and paid reviews are the examples givenA creator-style video that runs from your handle as if it were organic should say it is an ad
Department of Consumer Affairs, Endorsement Know-hows (20 January 2023)Anyone with an audience who can sway purchases must disclose any material connection, in simple words such as advertisement, sponsored or paid promotionUse plain labels; do not rely on a hashtag
Misleading advertisement guidelines, 2022Fines up to ₹10 lakh, and up to ₹50 lakh for later contraventions; endorsers can be barred for up to one year, or three for repeatsThe creator's name on your ad is exposure for them as well as for you

ASCI's influencer guideline is written for ads that influencers publish on their own accounts. When a creator's video runs from your handle, the ASCI Code's general honesty rules and its disguised-ads rule apply, and in our reading the same label logic does too. Ask your counsel about the edge cases. Three set-ups and how to run each

Set-upWhat you needHow we run it
A. Partnership ad with new media, from the creator's handleAccount-level permission, and the creator's approval of the exact cutApproval in writing for each version; label inside the video; creator can see the ad; end date logged
B. Brand-handle ad using creator contentA licence covering the file, edits and likenessLabel the ad as an ad; credit the creator if their face appears; never imply the creator posted it
C. Creator content from a Page or handle that is neither yours nor theirsNothing we would acceptWe do not run it. The viewer cannot tell who is selling, and the advertiser still carries the duty

In set-up B, a paid UGC creator who appears as an ordinary customer must not be presented as an unpaid customer. ASCI's examples of disguised ads include paid reviews, so the testimonial format needs the same care as any influencer post. Our UGC creators service briefs for this.

Contract clauses for dark use

ClauseWording idea
Consent to dark useThe brand may run the approved cut as an ad without publishing it on any feed
ApprovalEach version is approved in writing before it runs; changes to claims need a fresh approval
Name and likenessLimited to the approved cut; no synthetic or re-voiced versions
LabelThe disclosure stays in the creative for the durations ASCI sets
VisibilityThe creator can ask for screenshots or access to see each running version
TakedownThe ad is paused within a stated number of days of a request or a controversy
TermStart at go-live and end on a stated date, with the renewal price fixed

The dark-post log, and a weekly check

Keep one row per variant: ad ID, creative file and version, creator, claims sheet version, label timestamp, a screenshot of the permission, start and stop dates and the rights end date. The log also feeds how to pick influencer posts to boost, because it records which cut came from which post. Once a week, search your advertiser name in the Ad Library and compare it with the log. Anything running that is not in the log is the problem to fix first, and anything in the log that is no longer running should show a stop date.

Dark posting is not dark patterns

ASCI's guidelines on online deceptive design patterns, often called dark patterns, cover drip pricing, bait and switch, false urgency and disguised ads. Dark posting is a delivery method and dark patterns are deceptive designs. They overlap in one place: the disguised ad. A creator-style ad that does not say it is an ad belongs in both conversations.

Mistakes we would steer you away from

  • Treating dark as an exemption. The label rules follow the ad.
  • Not telling the creator. The ad uses their name and their face.
  • Running past the rights window. A dark ad has no feed post to remind anyone it is still live, so the end date lives in your log.
  • Trimming the label. A re-cut that removes it fails the creator and you.
  • No log. Six variants a month without a log become sixty unknown ads in a year.

Our compliance checklist for brands puts these checks on one page. To have creator ads planned with the approvals, labels and log built in, send us a brief.

Frequently asked questions

What is dark posting in influencer marketing?

Dark posting means running an ad whose creative is not published on any profile's feed, so only the audience you target sees it. Meta's pages call these ads or unpublished posts, and dark post is trade slang. With creator content it usually means new media uploaded in Ads Manager under the creator's handle or yours. See our creator ads and whitelisting page.

Is dark posting legal in India?

Nothing we found prohibits running an ad without publishing it, but every rule that applies to ads still applies to it. ASCI requires a clear disclosure label where there is a material connection, and says an ad in the format of organic content must say it is an ad. This is general information, not legal advice. See our ASCI influencer guidelines explainer.

Do dark posts need the paid partnership label?

Meta says creators and publishers posting branded content as an ad should use the branded content tool to tag their business partner, and partnership ads show the partner in the ad header. Keep the creator's own on-screen label as well, because ASCI wants an upfront, prominent label inside the content. See our paid partnership label guide.

Can anyone see my dark posts?

Yes, while they run. Meta's Ad Library lets anyone search ads that are currently active across its products, and ads that break its policies can appear there with a warning. We could not confirm from Meta's page how listings work for India, so search your own advertiser name there. See Instagram partnership ads setup.

Does the creator have to know about a dark post that uses their name?

They should, and the contract should say so. A partnership ad puts the creator's handle in the header under permission they can revoke, and the ad speaks in their name. Get written approval of each cut and give them a way to see it. Our usage rights guide treats name, face and voice as a separate line.

How do unlisted YouTube videos relate to dark posting?

An unlisted video can run as an ad without being public. Google says an unlisted video used as an ad will not show the channel logo, name or information. That is dark in effect, and the label rules still apply. For the creator-channel route, see our guide to influencer content for YouTube ads.

What should a dark-post log contain?

For each variant: the ad ID, the creative file and version, the creator, the claims sheet version, the label's timestamp, a screenshot of the permission, start and stop dates and the rights end date. Check it weekly against your active ads. Our creative testing guide explains why version control matters.
