In short
- Republic Day is Tuesday 26 January 2027 and Independence Day is Sunday 15 August 2027. Republic Day is 12 weeks away, so book creators now.
- The flag, the Ashoka Chakra and government names are protected from trade use under the Emblems and Names Act 1950. Keep them out of ad creative and merchandise.
- Never let creators print the flag on products, wrap items in it, put lettering on it or use it as bunting. Take legal advice before any flag imagery.
- Use local makers, civics explainers, long-weekend trips and deal guides, and substantiate every Made in India claim.
Independence Day and Republic Day influencer campaigns work when the brand talks about its own people and products, not when it borrows the flag. Good ideas include local makers, civics explainers, long-weekend travel and honest deal guides. The creative has to stay clear of the flag, the Ashoka Chakra and government names, which Indian law protects from trade use. This post is the national-days slice of our guide to influencer marketing in India.
Republic Day 2027 is 12 weeks away, so it is the one to plan now. The festival calendar for influencers shows both days in context, and the rules section below is the part most brands skip.
Dates for 2026 and 2027
| 2026 | 2027 | |
|---|---|---|
| Republic Day | Monday 26 Jan | Tuesday 26 Jan |
| Independence Day | Saturday 15 Aug | Sunday 15 Aug |
Both dates are on Office Holidays as national holidays. Three things to note for 2027:
- Republic Day on a Tuesday makes Monday 25 January a bridge day, so a four-day weekend of 23 to 26 January is likely for people who take leave. Travel and auto brands should plan for it.
- JEE Main session 1 is tentatively on 20 to 24 and 28 January, per Careers360, so aspirants and their parents are tense in the same week; see our exam-season playbook.
- Independence Day on a Sunday is two days before Raksha Bandhan on Tuesday 17 August, with the first fortnight of college classes alongside; see back-to-college campaigns and Raksha Bandhan ideas.
What audiences do online
In our experience, national-day content is a mix of three behaviours. People post their own flag-hoisting and school-event photos. They plan a trip if the weekend is long. And they browse sale pages that carry a patriotic banner. Audiences also notice quickly when a brand seems to be using patriotism to sell, so the content that holds up is specific: a named maker, a real place, a real price.
The rules first: flag, emblem and name
This section is general information, not legal advice, and counsel should clear any creative that shows the flag. The Flag Code of India, 2002 is published by the Ministry of Home Affairs; the points below come from the Ministry of Culture's FAQ on the National Flag, PIB's summary of the Flag Code and the text of the Acts.
The Emblems and Names (Prevention of Improper Use) Act, 1950. Section 3 bars anyone from using, for any trade, business, calling or profession, or in the title of a patent or in a trade mark or design, any name or emblem in its Schedule, or a colourable imitation, without the previous permission of the Central Government or an authorised officer. The Schedule includes the Indian National Flag, the names and emblems of the Government of India and of States, any name that suggests government patronage, the name or picture of Mahatma Gandhi or the Prime Minister (with a narrow exception for calendars that do not advertise goods), the Ashoka Chakra, and the names of Parliament, the Supreme Court and the High Courts. The Act's own penalty is a fine of up to ₹500, and prosecution needs government sanction. The penalty is small, but the commercial risks are not: takedowns, rejected trade marks and public backlash.
The State Emblem. The Lion Capital has its own law, the State Emblem of India (Prohibition of Improper Use) Act, 2005. Keep it out of brand content.
The Prevention of Insults to National Honour Act, 1971. Section 2 provides imprisonment up to three years, a fine or both for burning, defacing, trampling or otherwise showing disrespect to the flag in public view, by words or acts, as the Ministry of Home Affairs' advisory quotes it.
What the official FAQ says not to do with the flag. It should not be used as a festoon, rosette or bunting, or in any other manner for decoration. It should not be used as a portion of costume or uniform or accessory below the waist, or embroidered or printed on cushions, handkerchiefs, napkins, undergarments or dress material. There should be no lettering on it. It should not be used to wrap, receive or deliver things, or to cover the sides, back or top of a vehicle. It should not touch the ground, be shown damaged or upside down, or be flown from a car except by listed dignitaries. The Ministry's 2017 advisory also says paper flags only for events, not plastic, and that flags are not thrown away after.
| If the idea is | Why it is risky | Safer version |
|---|---|---|
| Flag printed on packs, T-shirts or merchandise | Trade use; dress-material rule | Words, places, makers and your own colour palette; take legal advice on tricolour accents |
| Logo, slogan or offer text over the flag | No lettering rule | Keep text on a flag-free background |
| Flags as bunting in a sale video | Decoration rule | Keep flag-hoisting to a creator's personal posts, and out of sponsored content |
| Unboxing wrapped in the flag | Wrap and deliver rule | Plain wrap and a handwritten note |
| Gandhi or Chakra in an ad | Schedule items | Name a local hero with consent, or skip |
| "Government approved" or "official" lines | Patronage rule | Say what you actually are |
| Plastic flags as giveaways | Ministry advisory | No giveaway, or paper only |
The flag code was amended on 30 December 2021 to allow machine-made and polyester flags, per PIB, so supply is not the issue; context is.
Ten ideas that do not need the flag
- Made here. Creators visit a maker in their city and film the work. Substantiate every "Made in India" claim with a document.
- Heritage walks. History creators film one site and check facts with a source.
- Rights and duties explained. Civics and law creators explain the Constitution for Republic Day without taking a political side.
- Thank-you films. Creators film nurses, teachers, delivery partners and sanitation staff, with consent and fair pay.
- The long weekend. Travel and auto creators plan 23 to 26 January road trips; see travel and hospitality.
- Deal guides. Deal-guide creators post offers with codes; see sale season.
- The 15-day streak. Fitness creators run a 15-minutes-a-day challenge, with no medical claims.
- Food in three colours. Food creators make dishes in saffron, white and green, with flag-free packs.
- One product, five languages. Regional creators tell your story in their own language; see regional influencer marketing.
- How to fly it right. A civics creator explains correct display, with no product in frame. The Ministry described #HarGharTiranga in 2022 as a citizen campaign; do not imply you are part of it.
Briefing creators on the rules
Creators often reach for the flag on instinct, as a prop, a backdrop, a cake topper, face paint or a printed kurta. Put the rule in the brief so that nobody has to guess in the middle of a shoot:
- In the frame: no flag, Chakra, emblem or government name in sponsored posts, including props and backgrounds.
- On the body: no flag-printed clothing or accessories in sponsored content.
- In the words: no claim of government approval, partnership or patronage, and no "official" in any handle or hashtag.
- In the edit: no music, effects or captions that make light of the flag, the anthem or the armed forces.
- In the comments: a moderation plan, because national-day posts attract heated replies.
A creator's own personal post is theirs. The moment money, product or a code is involved, the brief applies and so does the disclosure label.
What to measure
Count orders by creator code, and compare the national-day window with a normal fortnight, since sale pages and long weekends lift traffic anyway. For heritage and maker films, saves and watch time show interest better than likes. Count regional-language results separately; they usually need their own creators and their own baseline. Finally, record how many drafts changed after legal review. That number tells you whether next year's briefs need clearer rules.
A timeline for both days in 2027
| Step | Republic Day, 26 Jan 2027 | Independence Day, 15 Aug 2027 |
|---|---|---|
| Creators booked (10 weeks) | 17 Nov 2026 | 6 Jun 2027 |
| Legal review of creative and claims | By 1 Dec | By 20 Jun |
| Brief and contracts (6 weeks) | 15 Dec | 4 Jul |
| Products shipped | 5 Jan | 25 Jul |
| Drafts approved | 12 Jan | 1 Aug |
| Live window | 18 to 26 Jan | 8 to 15 Aug |
Budget notes
Use the ranges on our influencer rates guide: a nano Reel about ₹2,000 to ₹10,000, a micro Reel ₹8,000 to ₹80,000, a micro Story set ₹5,000 to ₹20,000 and a mid-tier Reel ₹50,000 to ₹3.5 lakh. These two days add a cost most festival plans do not carry, which is time for a legal read of every draft. Allow for it in the schedule, and for revisions: one published guide lists ₹5,000 to ₹30,000 for each round beyond two.
Keep exclusivity short or skip it, since national-day content is not a place where rivals compete for the same ritual. Usage rights add about 35 percent in our plans, and creator ad rights add 60 to 120 percent over an organic post in one published guide, with ad media separate. Management fees run about 15 to 25 percent of creator spend in published benchmarks. Our influencer cost calculator handles the tiers.
Disclosure, labels and claims
Patriotic framing does not remove the duty to disclose. Under the ASCI influencer guidelines, free products, fees and codes are a material connection, so a label such as Ad, Collaboration or Free gift has to be placed upfront: on the visual for a Story, and on screen for at least 3 seconds in a Reel of 15 seconds or less. The brand shares responsibility for claims, so a "100 percent Indian" or "Made in India" line needs proof you could show a regulator. See the ASCI guidelines explained. This is general information, not legal or tax advice.

Frequently asked questions
When are Republic Day and Independence Day in 2026 and 2027?
Republic Day is always 26 January and Independence Day 15 August. In 2026 they fell on Monday and Saturday. In 2027 Republic Day is on Tuesday 26 January, so many people take Monday 25 January off for a four-day weekend, and Independence Day is on Sunday 15 August, two days before Raksha Bandhan on Tuesday 17 August.
Can a brand use the Indian flag in influencer content?
Be very cautious. The Emblems and Names Act 1950 lists the Indian National Flag among protected emblems and bars its use for trade, business, trade marks or designs without government permission. The Flag Code also bars decoration, lettering and printing on dress material. Take legal advice before any ad shows the flag. Our pillar guide covers briefing creators.
Can influencers wear the tricolour or print the flag on merchandise?
Wearing tricolour colours is different from printing the flag. The Ministry of Culture's FAQ says the flag shall not be used as costume or uniform below the waist, and shall not be printed on cushions, handkerchiefs, napkins, undergarments or dress material. Do not make flag-printed merchandise. Tricolour colour accents are a legal question to ask counsel, not a safe default.
What is the penalty for misusing the national flag?
Under section 2 of the Prevention of Insults to National Honour Act 1971, burning, defacing, trampling or showing disrespect to the flag in public view can bring imprisonment up to three years, a fine or both. The Emblems and Names Act has its own lower fine for trade use. Reputational harm and platform takedowns are the larger commercial risks.
Which influencers work for Independence Day and Republic Day campaigns?
Local-maker and regional-language creators, history and civics explainers, travel and auto creators for the long weekend, food and fitness creators, and deal-guide creators for sales. Choose creators whose audiences expect this tone and ask them to disclose any paid link. Our regional influencer service casts by language.
How much does a national-day influencer campaign cost?
Creator fees follow normal published ranges: about ₹2,000 to ₹10,000 for a nano Reel, ₹8,000 to ₹80,000 for a micro Reel and ₹50,000 to ₹3.5 lakh for a mid-tier Reel. Add rights, ad spend, legal review of creative and a management fee of about 15 to 25 percent. See influencer rates in India.
